The Fine Print
Copyright Policy
How to tell us something on Curatery infringes your copyright, and what happens next.
Our Approach
Curatery respects the rights of creators and follows the U.S. Digital Millennium Copyright Act (DMCA). If you believe material on Curatery infringes a copyright you own or are authorized to act for, send a notice to our designated agent below. When we receive a complete notice, we will remove or disable access to the material expeditiously. We aim to act within 2 business days.
Designated Copyright Agent
Send copyright notices and counter-notices to:
Copyright Agent
Curatery
5343 Belleville Crossing Street #2045, Belleville, IL 62226, United States
Phone: -
Email: hello@curatery.com
This agent only handles copyright notices. For anything else, see our Contact page.
What a Notice Must Include
To be valid, your notice must be in writing and include:
- Your physical or electronic signature, as the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work you believe is infringed (or, for several works, a representative list)
- Identification of the material you believe is infringing, with enough detail for us to find it, such as the page address (URL)
- Your name, postal address, phone number, and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf
A notice missing these details may not be acted on. Knowingly misrepresenting that material is infringing can make you liable for damages, including costs and attorneys' fees.
What Happens After a Notice
- We remove or disable access to the identified material
- If a member posted it, we let them know it was removed and send them a copy of the notice, which includes your contact details
- We keep a record of the notice, including for our repeat infringer policy below
Counter-Notices
If material you posted was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to our designated agent. It must be in writing and include:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before it was removed
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of a mistake or misidentification
- Your name, postal address, and phone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district where your address is (or, if you are outside the United States, any judicial district in which Curatery may be found), and that you will accept service of process from the person who sent the original notice or their agent
When we receive a complete counter-notice, we send a copy to the person who sent the original notice. We restore the material, or stop disabling access to it, no less than 10 and no more than 14 business days after receiving the counter-notice, unless our designated agent first receives notice that they have filed a court action seeking to stop the activity.
Knowingly misrepresenting that material was removed by mistake can make you liable for damages, including costs and attorneys' fees.
Repeat Infringers
We close the accounts of members who repeatedly infringe copyright. A member who receives three valid copyright notices within any 12-month period will have their account terminated. We may also terminate an account sooner where the infringement is serious or clearly deliberate.
A notice doesn't count toward this if the material was restored after a valid counter-notice and no court action followed, or if the notice turns out to be invalid.
